Probate is the court-supervised process of transferring assets to heirs upon the death of an individual. Depending on the assets of the estate, the estate may or may not go through probate. An estate may have to go through probate even if there is a will in place. If an estate needs to go through probate, a petition must be filed with the county probate court to initiate the probate process.
